MagLiteracy.org respects and honors copyright and trademark rights, laws, and conventions. On our website, social media sites, and informational materials, we depict images of magazine and comic book covers individually or in groups, and images of people reading magazines and comics, either with explicit permission, or within the Fair Use doctrine. It is not our intent to inflict or cause harm to copyright owners. Contact us.
The Fair Use doctrine specifies four factors to evaluate whether or not a particular use is fair. We strive to remain within these guideposts, as follows:
- The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes. MagLiteracy.org is a 501(c)(3) educational charity that strictly uses images for non-commercial, non-profit, educational purposes to represent literacy needs defined by charitable community programs, schools, and libraries. Images are used to inform the public about the value of reading and providing magazines for literacy, mentoring, job training, and support for dislocated, at-risk children and families.
- The nature of the copyrighted work. MagLiteracy.org depicts published works as information or visual illustrations to help literacy programs and others identify the types of magazines and comics needed and available to meet community literacy needs, and to navigate to more detailed information about the magazines and comics available for distribution as reading resources. This improves our ability to match particular reading materials to specific literacy needs to improve the educational effectiveness of our literacy mission.
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole. The content of copyrighted works depicted by MagLiteracy.org, such as magazine and comic book covers, magazines and comics, and people reading magazines and comics, represent a minimal portion of larger publications.
- The effect of the use upon the potential market for, or value of, the copyrighted work. MagLiteracy.org is a charitable non-profit, non-commercial organization that does not compete with content owners or their commercial, artistic, or other ownership interests, or seek or produce pecuniary value by its activities.
